ANKARA (DİHA) - The Ankara Specially Authorized Chief Public Deputy Prosecutor's Office has ruled "lack of jurisdiction" for the investigation on the 15 deaths due to torture in Diyarbakır Military Prison after the 12 September military coup and sent the file to the Diyarbakır Chief Public Prosecutor's Office. The ruling said "the accusations of torture and inhuman treatment violating the right to life claimed by the complainers were not in the scope of Article 250 of the Law of Criminal Procedure."
Some of the 165 complainers' claims were mentioned in the ruling, such as that of Adem Ender Avcıkıran who claimed that Aziz Büyükertaş, 70-75 years of age at the time, was beaten to death by soldiers and Memet Takar who said that Medet Özbadem was killed in front of his eyes.
The ruling also noted that time limitation would not apply to the offenses defined as crimes against humanity according to the Article 77 in the Turkish Criminal Law. The offenses were defined as "killing by torture" and "torture and inhuman treatment" whereas the date of the offense was recorded as "1979 and after" in the ruling.
